The State Bar Is Under Public Pressure To Step Up Enforcement

Bar’s Board of Trustees approved expanded authority that gives the State Bar’s prosecution department—the Office of Chief Trial Counsel— greater reign to randomly audit the Client Trust Account of any California attorney. You could be an attorney who has practiced without a single complaint for 20 or 30 years, but still get disciplined (or even disbarred) if a random audit finds a mistake or a failure to timely and properly deposit client funds or settlement or even worse identifies over-payments to yourself or under-payments to clients!

Over the past few years, the Office of Chief Trial Counsel has ramped-up its enforcement against targeted attorney groups that were previously not an enforcement priority, such as immigration lawyers.
